Terms of Service

The products offered for sale are presented on the Site and accompanied by a description.

CAP D'ARSÈNE cannot be held liable in the event of an error or omission in any of these elements or in the event of modification of the said elements by suppliers, publishers or by any third party.

Connection to and browsing on the Site must comply with these terms, regardless of the technical means of access and the terminals used.

These general conditions apply, as necessary, to any variation or extension of the Site on existing or future social and/or community networks.

CAP D'ARSÈNE implements the technical solutions at its disposal to allow access to the Site 24 hours a day, 7 days a week.

For the proper management of the Site, the publisher may at any time:

(i) suspend, interrupt or limit access to all or part of the Site, reserve access to the Site or to certain parts of the Site for a specific category of Internet user;

(ii) remove any information that could disrupt the operation of the Site or constitute a violation of applicable regulations;

(iii) suspend the Site in order to carry out updates, modifications or generally any action deemed necessary for the proper functioning of the Site.

Access to the offers offered on the Site is subject to the Client's registration. Registration and access to the offers offered on the Site are reserved exclusively for legally capable natural persons, who have completed and validated the registration form available online on the Site, as well as these general conditions.

When registering, the Customer undertakes to provide accurate, sincere and up-to-date information on his person and his marital status.

The Customer must also regularly check the data concerning him in order to maintain its accuracy.

The Customer must therefore imperatively provide a valid e-mail address, to which the Site will send a confirmation of his registration. An e-mail address cannot be used several times to register on the Site.

Any communication made by CAP D'ARSÈNE and its partners on said e-mail address is therefore deemed to have been received and read by the Customer. The latter therefore undertakes to regularly consult the messages received on this e-mail address and to respond within a reasonable time if necessary. The Client's account is strictly personal and non-transferable.

Only one account can be created per Customer. The Customer is assigned an identifier allowing him to access an account whose access is reserved for him, in addition to entering his password. The Customer is the only one to hold and control access to his account.

The Customer must not communicate to anyone the access codes and confidential information relating to his account. The Customer is solely responsible for updating and maintaining accurate information relating to his account.

The username and password can be modified online by the Customer in the "My Account" interface. The password is personal and confidential, the Customer thus undertakes not to communicate it to third parties. CAP D'ARSÈNE reserves the right to refuse a request for registration on the Site in the event of violation of the provisions of these general conditions by the Customer.

The structure of the Site but also the texts, graphics, images, photographs, sounds, videos and computer applications that compose it are the property of CAP D'ARSÈNE and are protected as such by the laws in force under intellectual property.

Any representation, reproduction, adaptation or partial or total exploitation of the content, registered trademarks and offers offered on the Site, by any means whatsoever, without the prior, express and written authorization of CAP D'ARSÈNE, is strictly prohibited and would be likely to constitute an infringement within the meaning of the Intellectual Property Code, with the exception of elements expressly designated as free of rights on the Site.

Access to the Site does not constitute recognition of a right and, in general, does not confer any intellectual property rights relating to any element of the site. The Customer is prohibited from entering data on the Site which would modify or which would be likely to modify its content or appearance.

These general terms and conditions constitute a framework contract between CAP D'ARSÈNE and the Customer as of their acceptance by the latter. The contract is for an indefinite period and may be terminated at any time by the parties.

The regularly registered Customer may at any time request the termination of the contract and his unsubscription from the Site by going to the dedicated page on his account. Any unsubscription to the Site will be effective immediately after the Customer has completed the form provided for this purpose.

Although CAP D'ARSÈNE takes every precaution to ensure that the products are described accurately using the photos available on the Site, certain details (such as color, prints or texture) may vary depending on the resolution. of the Customer's screen and thus differ slightly from the product received.

CAP D'ARSÈNE cannot be held liable for this. CAP D'ARSÈNE is only responsible for the content that it has published itself.

It is expressly agreed that CAP D'ARSÈNE cannot be held liable in particular for:

(i) problems or technical, computer or compatibility failures of the Site with any hardware or software belonging to the Customer (ii) intrinsic defects of the Internet, in particular those relating to the lack of reliability and the lack of securing the information circulating there;

(iii) illicit activities that would be carried out against its will on the Site.

It is expressly agreed that the Customer is solely responsible:

(i) the protection of its material and data;

(ii) its use of the Site;

(iii) compliance with these terms and conditions.

This section illustrates CAP D'ARSÈNE's commitment to respecting the privacy and protection of the Customer's personal data.

The Client is informed that personal data concerning him is collected and processed by CAP D'ARSÈNE when he uses the Site.

The processing has been the subject of appropriate prior declarations to the National Commission for Computing and Liberties (CNIL).

Data collected - The data collected and subsequently processed by CAP D'ARSÈNE are those that the Customer voluntarily transmits when registering on the Site. The Customer will be informed of the mandatory or optional nature of the answers and the consequences of the lack of answer if there are any. When using the Site, certain data is collected automatically, in particular technical data (such as the IP address of mobile devices) and information relating to the consultation and use that the Customer makes of the Site's functionalities. Purposes of processing - The purpose of collecting and processing the Customer's personal data is to ensure the management of the commercial relationship between CAP D'ARSÈNE and the Customer.

The data may enable CAP D'ARSÈNE to send CAP D'ARSÈNE newsletters ("newsletters") in the form of notifications sent to the Customer's e-mail address. If the Customer no longer wishes to receive these newsletters, he can unsubscribe at any time by clicking on the link provided for this purpose at the bottom of each newsletter or by modifying his data from his account.

Recipients of the data - CAP D'ARSÈNE processes the Customer's data to ensure the operation of the Site. In this context, CAP D'ARSÈNE may be required to transmit certain Customer data to its technical or functional partners for the operation of the services, to the exclusion of any other use.

Transfer of data - The Customer is informed that his data may be transferred to a country other than his country of residence and in particular outside the European Union. CAP D'ARSÈNE carries out the transfer of this data in compliance with the provisions of the Data Protection Act No. 78/17 of January 6, 1978.

Data security - CAP D'ARSÈNE attaches particular importance to the security of the Customer's data and will implement all appropriate measures to limit the risk of loss, deterioration or misuse of such data.

Duration of data retention - The data is kept for the duration strictly necessary for the achievement of the purposes referred to above and will correspond to the legal deadlines for the retention of accounting and commercial documents by companies.

The rights of the Customer - The Customer has a right to access and rectify his data and a right to oppose their use by sending a request to this effect by mail to the address hello@capdarsene.com . He may also send CAP D'ARSÈNE directives relating to the fate of his personal data after his death.

The Site may contain hypertext links directing the Customer to other websites over which CAP D'ARSÈNE has no control.

Despite the prior and regular checks carried out by CAP D'ARSÈNE, it declines all responsibility for the content that can be found on these sites.

As part of the use of the Site, "cookies" may be used (tracers deposited and/or read on the Customer's computer equipment) to generate statistics and information on traffic, to facilitate navigation and to improve CAP D'ARSÈNE's offers for the convenience of the Customer.

The latter may oppose the recording of these "cookies" by configuring their browser software or by sending a request to CAP D'ARSÈNE. The Customer is informed that the continuation of the navigation on the Site without explicit refusal of the implementation of cookies is worth acceptance on his part.

These general conditions are subject to French law.

In the event of a dispute or complaint, the Customer shall first contact CAP D'ARSÈNE to obtain an amicable solution.

The Customer is informed that he is able to use the consumer mediation procedure under the conditions provided for in Title I of Book VI of the Consumer Code.

As such, CAP D'ARSÈNE informs the Customer that it is under the responsibility of the following mediator:
